Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Student," "Client," or "you") and Termopoggi Vocal Academy Pty Ltd ("Academy," "we," "us," or "our") regarding your use of our vocal instruction services, facilities, and website.

By enrolling in our programs, booking lessons, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services Provided

2.1 Vocal Instruction Services

Termopoggi Vocal Academy provides professional vocal coaching services including:

  • Individual singing lessons
  • Group vocal classes
  • Performance coaching and preparation
  • Vocal technique development
  • Music theory and ear training
  • Audition preparation
  • Masterclasses and workshops

2.2 Facility Access

Students enrolled in our programs receive access to our studio facilities during scheduled lesson times and designated practice periods, subject to availability and booking procedures.

2.3 Educational Materials

We may provide educational materials, sheet music, vocal exercises, and other resources as part of our instruction. These materials remain the intellectual property of the Academy unless otherwise specified.

3. Enrolment and Registration

3.1 Eligibility

Our services are available to individuals of all ages and skill levels. Students under 18 years of age must have written consent from a parent or legal guardian.

3.2 Registration Process

To enrol in our programs, you must:

  • Complete our registration form with accurate information
  • Provide emergency contact details
  • Disclose any relevant health conditions or physical limitations
  • Accept these Terms of Service
  • Pay applicable fees as outlined in our fee schedule

3.3 Health and Safety Declaration

Students must inform the Academy of any medical conditions, medications, or physical limitations that may affect their ability to participate safely in vocal instruction.

4. Fees and Payment

4.1 Lesson Fees

Current lesson fees are available on our website and in our printed materials. Fees are subject to change with 30 days' written notice to existing students.

4.2 Payment Terms

  • Individual lessons: Payment due at time of booking or before lesson commencement
  • Package deals: Full payment required upon purchase
  • Monthly programs: Payment due by the 1st of each month
  • Term programs: Payment due before term commencement

4.3 Late Payment

Late payments may result in suspension of services until accounts are brought current. A late fee of $25 may be applied to overdue accounts after 14 days.

4.4 Refund Policy

  • Cancellations more than 24 hours before lesson: Full refund or credit
  • Cancellations within 24 hours: 50% refund or credit
  • No-shows: No refund or credit
  • Package refunds: Pro-rata calculation for unused lessons
  • Medical emergencies: Case-by-case consideration with documentation

5. Scheduling and Cancellations

5.1 Lesson Scheduling

Lessons are scheduled by mutual agreement between student and instructor. Regular weekly slots are subject to availability and instructor schedules.

5.2 Student Cancellations

  • 24+ hours notice: Lesson may be rescheduled or credited
  • Less than 24 hours notice: 50% fee applies
  • No-shows: Full fee applies
  • Emergency situations will be considered on a case-by-case basis

5.3 Academy Cancellations

If we need to cancel a lesson, we will provide as much notice as possible and offer:

  • Rescheduling to a mutually convenient time
  • Full credit for future lessons
  • Full refund if preferred

5.4 Make-up Lessons

Make-up lessons for student cancellations are subject to instructor availability and must be scheduled within 4 weeks of the original lesson date.

6. Student Responsibilities

6.1 Attendance and Punctuality

  • Arrive on time for scheduled lessons
  • Notify the Academy promptly of any schedule changes
  • Come prepared with required materials and music
  • Maintain consistent practice schedule as recommended

6.2 Respect and Conduct

  • Treat all staff, instructors, and fellow students with respect
  • Follow studio rules and safety guidelines
  • Maintain appropriate volume levels during practice
  • Report any facility issues or safety concerns immediately

6.3 Equipment and Facilities

  • Use Academy equipment and facilities responsibly
  • Report any damage immediately
  • Clean up after use
  • Students are responsible for damage caused by negligence

7. Intellectual Property

7.1 Academy Materials

All teaching materials, methods, arrangements, and proprietary content created by the Academy remain our intellectual property. Students may use these materials for personal practice and education but may not reproduce, distribute, or commercially exploit them.

7.2 Student Recordings

The Academy may record lessons for educational purposes with student consent. Students retain rights to their vocal performances but grant the Academy permission to use recordings for promotional and educational purposes unless specifically requested otherwise.

7.3 Copyright Compliance

All students and instructors must comply with copyright laws regarding music used in lessons and performances. The Academy is not responsible for copyright violations by students.

8. Limitation of Liability

8.1 Assumption of Risk

Students acknowledge that vocal instruction and performance activities carry inherent risks. While we maintain professional standards and safety protocols, students participate at their own risk.

8.2 Liability Limitations

To the maximum extent permitted by law, the Academy's liability is limited to the amount paid for services. We are not liable for indirect, consequential, or punitive damages arising from our services.

8.3 Medical Conditions

Students with pre-existing medical conditions should consult healthcare providers before beginning vocal instruction. The Academy is not responsible for aggravation of pre-existing conditions.

8.4 Personal Property

The Academy is not responsible for loss, theft, or damage to personal property brought onto our premises. Students bring items at their own risk.

9. Privacy and Confidentiality

We respect your privacy and handle personal information in accordance with our Privacy Policy and Australian privacy laws. Lesson content and student progress remain confidential except where disclosure is required by law or consented to by the student.

10. Performance Opportunities

The Academy may offer performance opportunities including recitals, competitions, and public performances. Participation is voluntary and subject to instructor recommendation and student preparation level. Additional terms may apply to specific events.

11. Termination

11.1 Student Termination

Students may terminate their enrolment at any time with 14 days' written notice. Refunds for prepaid lessons will be calculated on a pro-rata basis.

11.2 Academy Termination

The Academy reserves the right to terminate student enrolment for:

  • Non-payment of fees
  • Violation of these Terms
  • Inappropriate conduct or behaviour
  • Safety concerns
  • Failure to meet health requirements

12. Force Majeure

Neither party shall be liable for delays or failure to perform due to causes beyond reasonable control, including but not limited to natural disasters, government orders, pandemics, or other emergencies. During such events, the Academy will work with students to provide alternative arrangements where possible.

13. Amendments

These Terms may be updated periodically. Students will be notified of significant changes via email or posted notices. Continued use of our services after notification constitutes acceptance of revised Terms.

14. Dispute Resolution

14.1 Informal Resolution

We encourage students to discuss any concerns directly with their instructor or Academy management for prompt resolution.

14.2 Formal Complaints

Formal complaints should be submitted in writing to management. We will respond within 14 business days and work towards a fair resolution.

14.3 Mediation

If direct resolution is not possible, disputes may be referred to mediation through a recognised dispute resolution service.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any legal proceedings must be brought in the courts of Melbourne, Victoria.

16. Severability

If any provision of these Terms is found to be unenforceable, the remainder of the Terms shall continue in full force and effect.

18. Acknowledgement

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You also acknowledge that you have the legal capacity to enter into this agreement or, if under 18, that a parent or guardian has consented to these Terms on your behalf.
